1. Acceptance of Terms
By downloading, installing, or using the CalBite mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Description of Service
CalBite is a nutrition and calorie tracking application that provides:
- AI-powered food recognition and calorie estimation
- Barcode scanning for packaged foods
- Manual food logging and database search
- Calorie and macro nutrient tracking
- Water intake tracking
- Exercise logging
- Personalized nutrition plans and goals
- Progress tracking and analytics
3. User Accounts
3.1 Account Creation
You may use CalBite without creating an account. However, to sync data across devices, you must sign in using Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Responsibilities
You agree to provide accurate and complete information when creating an account and to update your information as needed. You are solely responsible for all activities that occur under your account.
4. Subscription and Payments
4.1 Subscription Plans
CalBite offers subscription-based access to premium features. Subscription options include monthly and yearly plans, with a 3-day free trial available for new users.
4.2 Billing
Subscriptions are processed through the Google Play Store. By subscribing, you agree to their respective payment terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
4.3 Cancellation and Refunds
You may cancel your subscription at any time through the Google Play Store. Refunds are handled according to the respective store's refund policy.
5. User Content and Conduct
5.1 User Content
You retain ownership of any content you submit to CalBite, including food photos and personal data. By using the App, you grant us a license to process this content to provide our services.
5.2 Prohibited Conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the App's functionality
- Reverse engineer or attempt to extract source code
- Use automated systems to access the App
- Share your account with others
6. Intellectual Property
The CalBite App, including its design, features, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SUBSCRIPTION IN THE PAST 12 MONTHS.
9. Indemnification
You agree to indemnify and hold harmless CalBite and its affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
10. Termination
We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
